Nature of Services
- Connecting Patients and Hospitals: It allows patients to identify and connect with hospitals offering financial assistance options through Payton. It helps hospitals to manage and process Insurance claims applications effectively through us.
- Application Facilitation: Provides a structured framework for patients to submit their claim applications, including necessary documentation. Helps hospitals to review, track, and process applications in a timely manner, including the financial and other backgrounds of patients.
- Information Repository: Serves as an educational resource for patients, providing details about eligibility criteria, and claim processes. Helps hospitals to communicate options and requirements to patients.
- Transparency and Status Tracking: Enables patients to track the status of their claim applications in real-time. Facilitates clear and transparent communication between patients and hospitals regarding financial aid decisions.
- Support and Guidance: Offers support to patients in understanding their options and completing the claim application process. Assists hospitals with managing claim applications and required documents and addressing patient queries.
- eNACH Facility: This Platform provides services to facilitate the setup of eNACHmandates for recurring or one-time payments. Act as a conduit for sharing mandate- related information between patients, banks, and hospitals. Offer users tracking andstatus updates for their eNACH mandates.
The platform does not provide direct financial assistance or funding, make decisions regarding the approval or denial of processing of claims, or offer medical advice, treatment, or healthcare services.
Disclaimer: The platform is not responsible for the final decision or outcome of processing of claim documents and acts solely as a facilitator to enhance the efficiency of the process.
Basic Introduction on Payton what we do or doesn't do
- Payton is only a service provider and assists patients and hospitals in submitting the claim documents to the insurance.
- Payton doesn't collect charges from patients for documentation and submission of the claims. If a patient needs any additional services, this may be charged upon patient consent.
- Payton is not an insurance company or a TPA, neither have any partnershipwith them nor with their agents.
- Payton handles and stores the documents maximum upto 6 months, post which data is deleted. Hospitals or patients may request the documents and the same are provided without any charges.
- Payton doesn't take any responsibility for the claim processing / delay/ denial/ financial outcomes of the claims. This may be handled between the patient and his/her insurance.
- Payton doesn't offer any discount or covers no portion of hospital/ medical bills.
- Payton does not alter any hospital documents, neither recommends it. These documents are only collected, validated and submitted to the insurance.
- Patient health declaration is his/her sole responsibility at the time of admission. Payton holds no responsibility for non-declared health parameters.
- Payton is not a promoter of any insurance/ or its plans.
- Payton is not a promoter of any Hospital/ Doctors. Visiting a particular hospital/ doctor is a complete sole choice of the patient.
- Payton doesn't influence for applying of insurance reimbursement. Whether to proceed or not, its completely a patient responsibility.
- Payton collects the patient documents such as KYC from the hospital via a protected channel. Hospitals are recommended to maintain data security.
- Payton is an independent company and not a IRDAI recognised body.
- Payton does not produce any medical bills/ medical advice.
Terms and Conditions of Use
Welcome to Payton Terms and Conditions of Use (these "Terms"). This is a contract between you and Payton (as defined further below) and we want you to know your and our rights before you use the Payton website ("Payton" or the "Website"). Please take a few moments to read these Terms before enjoying the Website, because once you access, view or use the Website, you are going to be legally bound by these Terms (so probably best to read them first!).
User Responsibilities
Accurate Information: Users must ensure the accuracy of the information provided, including personal details, bank account information, and medical treatment costs.
Authorization: Users explicitly authorize the Platform to process eNACH mandates with their chosen bank.
Compliance: Users agree to comply with all applicable financial and data protection laws.
Payment Obligations: Users are responsible for ensuring sufficient funds in their bank accounts for the processing of eNACH payments.
Healthcare Provider Responsibilities
Transparency: Healthcare Providers must clearly communicate the costs associated with medical treatments.
Compliance: Healthcare Providers agree to use the Platform in compliance with applicable laws and ensure timely updates on treatment plans.
Types Of Content
There are three types of content that you will be able to access on the Website:
- content that you upload and provide ("Your Content");
- content that hospitals/clinics/doctors provide;
- content that the banks/financial institution provide, and
- content that the Payton Group provides (including, without limitation, database(s) and/or software) ("Our Content").
Restrictions On The Website
You agree to:
- comply with all applicable laws, including without limitation, privacy laws, intellectual property laws, anti-spam laws, equal opportunity laws and regulatory requirements as required within the territory of the State/Country where you are residing including the Information Technology Act, 2000 and Indian Contract Act, 1872;
- use your real name and real age in creating your Payton account and on your profile; and
- use the services in a professional manner.
You agree that you will not:
- act in an unlawful or unprofessional manner including being dishonest, abusive or discriminatory;
- misrepresent your identity, your age, your current or previous positions, qualifications or affiliations with a person or entity;
- disclose information that you do not have consent to disclose;
- develop, support or use software, devices, scripts, robots, different types of mobile code or any other means or processes (including crawlers, browser plugins and add-ons or other technology) to scrape or otherwise exfiltrate from Payton or its services, or otherwise copy profiles and other data from the services.
Indemnity
All the actions you make and the information you post on Payton remain your responsibility. Therefore, you agree to indemnify, defend, release, and hold us, and our partners, licensors, affiliates, contractors, officers, directors, employees, representatives and agents, harmless, from and against any third-party claims, damages (actual and/or consequential), actions, proceedings, demands, losses, liabilities, costs and expenses (including reasonable legal fees) suffered or reasonably incurred by us arising as a result of, or in connection with:
- any negligent acts, omissions or willful misconduct by you;
- your access to and use of the Website;
- the uploading or submission of Content to the Website by you;
- any breach of these Terms by you; and/or
- your violation of any law or any rights of any third party.
The Platform acts solely as a facilitator for eNACH transactions and is not responsible for: delays or failures in payments caused by banks or technical issues, disputes related to medical treatment, costs, or outcomes, or any Unauthorized transactions arising from user negligence. The Payton's liability is limited to the extent of the fees paid by the User for a specific eNACH transaction.
KYC verification
Undertaking your KYC: You authorize us (and any third party appointed by us) to facilitate your KYC process as may be required from time to time. This may include asking you for the documentation required under law as well as additional information, or verifying your information against third party databases or other sources. We may be forced to limit or refuse your usage of the Services if you refuse to comply with the KYC requirements that are required by law. As the process of gathering, verifying, auditing, and maintaining accurate and up-to-date information on you is ongoing, we retain the right to take whatever measures are required at any time to guarantee compliance with all pertinent and applicable KYC standards.
Unauthorized use of the Platform
If you think someone has entered your Subscribed Account without your permission, let us know right once. Please send us an email at providercare@paytonhealth.com if you believe something of the type has happened. The earlier you notify us of the incident, the better positioned we'll be to stop or reduce any losses.
Force majeure
Without limiting the aforementioned, we are not responsible for any harm or loss brought on by a failure in the provision of the Services resulting from direct or indirect acts of nature, forces, or causes outside our reasonable control, such as, but not limited to, internet outages, computer equipment failures, telecommunication equipment failures, or any other government regulations, floods, storms, electrical failure, civil disturbances, or riots.
Intellectual property
- All of the content on the Platform, including, all images, illustrations, graphics, video clips, text, reports generated, trademarks, as well as the underlying code of the Platform ("Platform Content"), constitutes our intellectual property
- Without our prior written consent, you are not permitted to directly or indirectly copy, distribute, modify, display, or use for commercial gain any of the Platform Content, Features, or Facilities.
Governing law & arbitration
- These Terms and any action related thereto will be governed by Applicable Law. Any disputes arising out of or related to these Terms and/or the Platform, or the Services (collectively, "Dispute") shall be subject to the jurisdiction of the courts located at Bangalore, Karnataka, India.
- Any and all Disputes shall be referred to and finally resolved by arbitration, held in accordance with the provisions of the Arbitration and Conciliation Act, 1996, including any amendment or modification thereto. The arbitral tribunal shall consist of a sole arbitrator appointed by the Company. Bangalore will serve as the arbitration's location and seat. All parties must abide by the arbitrator's award and decision, which are final. English will be used in the arbitration hearings. Unless otherwise specified in the decision, each party is responsible for its own costs and expenses related to the arbitration.
- Disputes related to eNACH transactions will be resolved as per NPCI guidelines. Any disputes between Users and Healthcare Providers regarding medical treatment must be resolved directly between the parties. The Platform is not liable for such disputes. Other disputes involving the Platform will be subject to arbitration as mentioned above
General provisions
Assignment: You shall not assign or transfer any right or obligation that has accrued to you under these Terms, and any attempt by you to assign or transfer such rights and obligations, shall be null and void. Any rights or obligations that have accumulated in our favour may be freely assigned or transferred at our discretion.
Waiver: Any delay or failure on our part to exercise any rights or remedies under these Terms and/or other policies on the Platform, unless expressly stated otherwise, shall not constitute a waiver of those rights or remedies, and no single or partial exercise of any rights or remedies hereunder shall preclude any further exercise of those rights or remedies by us.
Survival: You acknowledge that your representations, undertakings, and warranties and the clauses relating to indemnities, limitation of liability, governing law & arbitration shall survive the efflux of time and the termination of these Terms.
Severability: The validity, legality, and enforceability of the remaining terms included herein shall not be in any way affected or hindered by the illegality or enforceability of any part of these Terms. To the extent permitted by applicable law, any such provision found to be invalid, unlawful, or unenforceable shall be replaced by a provision of like import reflecting the original intent of the parties.
Acceptance: By using the Website, you acknowledge that you have read these Terms and agree to be bound by them. Please be aware that if we believe you have violated these Terms, we have the right to restrict, suspend, or terminate your use of the Platform at any time. In order to confirm your location, we may also monitor or employ specific technologies to track your online activity, including your IP address. Payton's core service of assisting patients and hospitals in submitting standard insurance claim documents (cashless or initial reimbursement filing facilitated via hospital partnership) is typically provided without direct charges to patients when facilitated through partner hospitals. Hospitals may have separate service agreements with Payton.
Additional services, requested directly by a patient (e.g., extensive follow-up on complex reimbursement claims, appeals for rejected claims, detailed settlement verification beyond standard checks, handling claims not initiated via a partner hospital), may incur a service fee.
Service Fees for Additional Services
If you request additional services beyond our standard scope, you will be informed upfront about any applicable service fees. We will provide a clear explanation of the service and the associated charge before you agree to proceed. Pricing is determined based on the complexity and scope of the requested service and is not listed on the website.
Payment Method
Payment for any agreed-upon additional service fees must be made directly to Payton Healthcare Solutions Pvt Ltd. Our team will provide you with the official payment options, which may include a secure payment link or company QR code. Please make payments only through the channels provided by our authorized representatives.
Refunds
Service fees paid to Payton for additional services rendered are generally non-refundable, as they cover the expertise, time, and resources utilized in providing the support. This policy does not affect any payments made to or received from insurance companies, which are governed by your insurance policy terms.
Scope of Services & Disclaimer
Our role is to provide assistance based on our expertise in claim filing, management, and tracking. We do **not**:
- Collect insurance premiums.
- Disburse claim settlement amounts (these come directly from the insurer).
- Guarantee the approval of any insurance claim or the amount of settlement.
- Mediate financial transactions or disputes between you and your insurer or hospital (beyond providing claim process support).
Your Responsibility
You remain solely responsible for:
- Making premium payments to your insurer.
- Providing accurate and complete information required for claim processing.
- Understanding the terms and conditions of your insurance policy.
- Following up directly with the insurer regarding the final settlement payout after approval, if necessary.
Insurer Responsibility
The final decision on claim approval, settlement amount, and disbursement rests solely with the insurance company or TPA, based on your policy terms and their assessment.
Limitations of Liability
Payton assumes no liability for the outcome of your insurance claim (approval, rejection, or settlement amount) or for disputes regarding payments between you and your insurer or healthcare provider. Our liability is limited to the provision of the agreed-upon claim assistance services.
Disputes
Disputes regarding claim decisions or settlements should be directed to your insurance company or TPA. Payton may provide documentation or details related to the claim process we handled to support you, but we are not responsible for resolving the dispute itself.
Acknowledgment
By using Payton's additional paid services, you acknowledge that Payton acts as a facilitator and support provider for the claim process and is not the decision-maker regarding your insurance policy's financial aspects. You agree to hold us harmless for claim outcomes and payment-related disputes with insurers or providers.
Acceptance: By requesting and agreeing to pay for additional services from Payton Healthcare, you acknowledge that you have read these Payment Terms and agree to be bound by them.
